The booking of an apartment is confirmed by acceptance of the following Terms & Conditions, and validation of the booking deposit payment by Clickappart.
The balance of the rent and possible additional services, as well as safety deposit must be paid and credited on Clickappart's account at the latest on the day of arrival.
Arrival - Departure
Arrivals are scheduled from 3pm to 8pm, and departures from 8am to 11am. Outside of this time frame, the following additional fees may apply:
Early arrival (before 3pm) or late departure (after 11am): 1/2 night fee
Late arrival (after 8pm) or early departure (before 8am): 40€
The contract will terminate itself by full right on the date specified on the booking, date on which the Lessee must vacate the premises. Should the Lessee remain in the premises after this date, an additional fee of 300€ per additional night will be payable to the Lessor, unless otherwise agreed in writing with the Lessor.
Number of guests
The maximum number of guests is specified in the apartment description on www.clickappart.com. It can by no means be exceeded, under the risk of damages and interests, and cancellation of the contract.
Penalty clause – deposit
In the event of withdrawal, it is agreed that:
Clickappart will be required to return double the amount of the deposit as damages and interest, within seven days after withdrawal. The Lessee will lose the deposit if he withdraws more than three weeks before the lease takes effect; if he withdraws less than three weeks before the lease takes effect, he will also pay to the owner the difference between the deposit and the equivalent of the total rent, as penalty.
In the event of non-payment of the agreed balance at the date set for turnover of the keys, Clickappart reserves the right to terminate the present lease immediately, with the Lessee remaining liable for the amounts due.
If a delay of more than three days in relation to the scheduled arrival date has not been reported by the Lessee, Clickappart may, by right, attempt to re-lease the unit while retaining the right to take action against the Lessee.
Obligation to occupy the premises personally, to live there "as good pater familias," and to maintain them. The Lessee undertakes in any case not to assign or sublet the present lease, even free of charge, without Clickappart's written consent.
Obligation to ensure that the neighbours are not disturbed by the fact of the Lessee or his family (noises, smells, fumes, lights, etc.) and to comply with the condominium bylaws.
All fixtures are in good working order, and any complaint concerning them made more than 24 hours after the commencement date will not be accepted. Repairs made necessary by negligence or poor upkeep during the lease will be borne by the Lessee.
Modifications to the premises and disposal of the furnishings are prohibited. The premises are rented with kitchen equipment, dishware, glassware, blankets and pillows, as indicated in the attached description. If warranted, Clickappart will be entitled to claim from the Lessee upon his departure the total value at replacement price of the objects, furniture or equipment broken, cracked, nicked or worn, and any items whose wear exceeds what is normal for the rental period, the price for cleaning dirtied blankets, and compensation for wear of any kinds involving the curtains, wallpaper, ceilings, rugs, carpeting, windows, bedding, etc. ...
Apartments are strictly non-smoking. Candles and incense are not tolerated.
If Internet access is available in the apartment, Clickappart is not liable in the event of malfunction due to the Internet access provider, or in case of incompatibility with the Lessee's computer. The Lessee is informed that a telephone line is not associated with the internet connection. Internet connections made during the Lessee's stay are done so entirely under the Lessee's responsibility, and the Lessee is expressly forbidden from visiting sites forbidden by the law, proceeding to the illegal downloading of files and broadcasting files forbidden by the law.
Household linens (sheets, towels, bathmat, dishcloth...) are supplied by a professional laundry. The Lessee is not allowed to wash them himself.
In the event of force majeure, Clickappart reserves the right to relocate the Lessee in an apartment of equivalent or higher category.
Insurance
The owner undertakes to have the unit insured against rental risks on behalf of the Lessee. The latter is obligated to report to it within 24 hours any accident occurring in the unit, its appurtenances or accessories, and renounces any recourse against the Lessor (owner of the apartment and Clickappart), and its insurance.
Cickappart shall not be liable for any damage to Lessee's property occurring from fire, calamity, plumbing, electrical, failure of appliances, gas or caused by water, snow, ice, arising from the acts or neglects of other occupants of the building, or any owners or occupants or adjacent or contiguous property, or caused by failure of wiring, lighting, heating, or cooling apparatus or damaged by theft or break-in. Lessee takes responsibility to cover personal belongings if they want coverage and will not pursue Clickappart for claims of any such loss or damage.
Security deposit
As guarantee and security against damages that may be caused to the premises or to the furniture and/or objects furnishing the premises, on the day of his arrival, the Lessee will hand in to Clickappart an amount equivalent to minimum 300€ to maximum 25% of the total of the stay. This non-interest-bearing sum is a pre-authorization on the Lessee's credit card (Visa, MasterCard), which will be cancelled at the latest 10 days after the Lessee's departure, upon proof provided by the Lessee that:
No piece of furniture, object or article of bedding is missing, worn or sullied, or, as the case may be, its restoration or replacement by an identical piece has been agreed with the Lessor, who accepts it. The premises have not been subjected to wear and have been cleaned (closets, dustbins and refrigerators emptied of waste, bathroom fixtures, household appliances, dishware washed and put back in place, etc...). The environment remained smoke-free. If the security deposit is insufficient, the Lessee hereby undertakes to make up the amount.
The Lessee may not object to an inspection of the premises when the owner or his representative so request. He will authorise the Lessor to make all repairs that appear urgent and necessary during the rental, without claiming compensation or a reduction in rent.
This rental agreement is made under ordinary conditions and laws applicable in France, and in particular those mentioned above, that the Lessee commits to fulfill. Failure to comply with the fixed conditions would render the contract nul and void, if Clickappart sees fit, without compensation or a reduction in rent.
